GENERAL RULES - Art. 11 - D.P.R. 430/2001 CONTEST NAMED ‘FIEMME SMILE’

This contest is promoted by AZIENDA PER IL TURISMO FIEMME e CEMBRA soc.cons.r.l., whose registered office is situated in Cavalese (TN-Italy), via F.lli Bronzetti 60 | Register of Companies: Trento | Company Membership number: 01901280220 | Registered Capital: Euro 220.000,00 | VAT: 01901280220 (hereinafter referred to as ‘Promoting Subject’ or ‘APT Fiemme’)

NAME OF THE CONTEST:
Fiemme Smile

PERIOD:
The period for the contest starts at 12.00 noon on 18/12/2024 until 12.00 noon on 31/01/2025. Drawing by 7 February 2025.

RECIPIENTS:
European Union residents over the age of 18 who are citizens of the territories involved or foreigners with a valid residence permit at the time of delivery of the possible prize, registered on the social networking site ‘Instagram’ (hereinafter the ‘Users’).

The following are excluded from the competition

• persons domiciled and/or resident outside the European Union
• minors

PURPOSE OF THE CONTEST:
Contest to promote Val di Fiemme and Val di Cembra brand.

PRIZES:

• 1 (one) 2-night stay in a 3s hotel for 2 people in Val di Fiemme with ski pass included and Voucher for a gourmet dinner in a restaurant in Val di Fiemme worth €720 + VAT. The stay may take place between 8 March and 25 April 2025 (subject to availability).
• 2 (two) 2-night stays in a 3s hotel for 2 people in Val di Fiemme with ski pass included worth €600 + VAT each. The stay can be taken between 8 March and 25 April 2025 (subject to availability).

CONTEST MODALITIES:

From 18 December 2024 a series of public and promotional posts (hereinafter the ‘Public Posts’) will be published on the Promoting Subject's Instagram profile @visitfiemme (https://www.instagram.com/visitfiemme/). In order to participate in the Contest, Users must, by 31 January 2025:

• access from mobile or desktop, the Instagram page @visitfiemme (https://www.instagram.com/visitfiemme/);
• identify and comment on the Public Posts, including promotional ones, of the Contest, tagging in the comment at least 2 (two) @friends' user names; 

• each User must become a follower of the Instagram page @visitfiemme

• each User must finally confirm his/her participation by filling in the electronic form available at the web address https://www.visitfiemme.it/en/fiemmesmile (requesting first name, last name, email address and @instagram user name)

LIMITS TO PARTICIPATION IN THE CONTEST

• Users' comments must still be visible after the contest expires, at the time of the drawing of the winners;
• Users must still be followers of the @visitfiemme page at the contest deadline, during the drawing of the winners;
• Users who have not confirmed their participation through the electronic form will be excluded from the draw, even if they have completed the comment, tag and follow requirements
• each User may participate in the contest only once during the entire period of the contest, regardless of the number of comments posted or confirmations made on the site form. Therefore, it will be possible for a single User to post multiple comments or confirmations on the site form, but only the first comment posted will be considered valid for the purposes of the competition.
• Users who, for any reason whatsoever, are only registered on the site's confirmation form system (i.e. it will not be possible to verify the actions on Instagram foreseen in the aforementioned ‘Contest modalities’) will be excluded from the awarding of the prize.

The Promoting Subject reserves the right to verify and cancel any participation subsequent to the first one that can be traced back to the same participating User and/or that does not comply with the requirements indicated; comments subsequent to the first one that can be traced back to the same identity may therefore be invalidated even retrospectively and in the event of a win the same will be cancelled and the prize awarded to a reserve. 

All those Users who, according to the unquestionable judgement of the Promoting Subject or of third parties appointed by the same, are found to be winners by means and instruments deemed suspicious, fraudulent or in breach of the normal course of the initiative shall also be excluded from participation in the Competition and shall therefore not be entitled to any prize won.
The Promoting Subject or third parties appointed by the same, reserve the right to proceed, in the terms deemed most appropriate, and in compliance with applicable laws, to limit and inhibit any initiative aimed at circumventing the system devised.

The Promoting Subject also reserves the right to

• carry out the appropriate checks, possibly cancelling registrations, participations or winnings made, according to the unquestionable judgement of the Promoting Subject or of third parties appointed by the same, contrary to the provisions of the Regulations or by means, methods and/or tools deemed suspicious, fraudulent or in breach of the normal course of the initiative and, consequently, excluding from participation
• Users who fail to comply with the rules, possibly also cancelling any winnings already achieved;
• proceed, in the terms deemed most appropriate and in compliance with the laws in force, to limit and inhibit any initiative aimed at circumventing the system devised
• disqualify a competitor if any behaviour is carried out to circumvent the devised game system (including, but not limited to, hacking, creation of temporary, fictitious accounts, multiple participations, etc.). 

These participations will be subject to verification.

Any irregularities will result in forfeiture of the right to receive the prize and therefore in such a case the prize will be awarded to a reserve.
Comments must not be contrary to public morality or offensive to things or people; therefore in such cases the Promoting Subject reserves the right to eliminate them at any time, and at its sole discretion.

In order to participate in the Contest, users must expressly accept these regulations, which will be available for consultation prior to registration.

ASSIGNING FINAL PRIZE
Users who, at the end of the contest, have completed the contest registration confirmation form will participate in the draw. By submitting the confirmation, the user declares, with assumption of responsibility, that he/she has completed the comment, tag and follow requirements (see Contest Modalities).

The single draw will be carried out randomly by 7 February 2025. 

During the draw, among all users who have filled in the electronic form confirming their participation, the following will be drawn:

• 1 (one) winner and 3 (three) reserves for the prize of 1 (one) 2-night stay in a 3s hotel for 2 people in Val di Fiemme with ski pass included and Voucher for a gourmet dinner in a restaurant in Val di Fiemme worth €720 + VAT. The stay can take place between 8 March and 25 April 2025 (subject to availability).
• 2 (two) winners and 4 (four) reserves for the prize of 2 (two) 2-night 3s hotel stays for 2 people in Val di Fiemme with ski pass included worth €600 + VAT each. The stay may take place between 8 March and 25 April 2025 (subject to availability).

Verification of the requirements (see ‘Competition Modalities’) for the persons/users drawn (‘winners’ and their ‘reserves’) shall be carried out by the five-member commission appointed by APT Fiemme.

Once the verification of requirements has been completed, the same commission shall be responsible for announcing the winners.

TOTAL PRIZE MONEY
Total value of € 1,920 + VAT

The Promoting Subject is not liable or responsible for any problems regarding access, failure, malfunction or difficulty that might prevent users from entering the service and the contest. Prizes may not be transferred. Selected winners unable or unwilling to redeem their will not be entitled to any money. The prize cannot be converted into cash or other forms of monetary retribution. Vouchers do not entitle to reimbursement for services booked with them.

RESPONSIBILITY REGARDING THE SCOPE OF PRIZES:

For what concerns the above-mentioned prizes, it should be noted that: no responsibility is attributed to the Promoter in case of accident and/or injury occurred to the winners of the above-mentioned prizes; no responsibility is also attributed to the Promoter for the services offered during the holiday/stay won.

COMMUNICATIONS, ACCEPTANCE OF WINNINGS AND DELIVERY OF PRIZES
The winner will receive an e-mail notifying him/her of the prize won with all indications regarding the rules for awarding the same. A scan of an identity document will be requested for verification of requirements.

After 5 (five) working days have elapsed, the winner shall lose the right to claim the prize and the Promoting Subject shall proceed to contact the first reserve drawn, who shall have to respect the same timeframe (5 working days) as the winners of the prizes drawn.

Notification of the announcement of the winner and the relative name and surname shall be published on the visitfiemme.it website on the same page of these regulations and shall sanction the public conclusion of the competition.

Please note that:

• if, following a check, the winner's personal data should prove to be incorrect or it should not be possible to identify the winning name, or in any case the data provided during registration should prove to be ‘invalid/existent’, the winner's participation will be cancelled and the prize will be awarded to the reserves and if the reserve's participation should also prove to be ‘invalid/existent’, to the non-profit organisation indicated below;
• Users who, according to the unquestionable judgement of the Promoter Subject or of third parties appointed by the same, are found to have participated and won by communicating false data or in any case in violation of the normal course of the initiative, will not be able to take advantage of the prize won in this way
• in the event of a win, the prize will be awarded to the holder of the email as registered on the promoter company's systems

COMPLIANCE AND GUARANTEES

The initiative will be advertised through communication on the Promoting Company's channels. Pursuant to art. 11 of the Italian Presidential Decree 26/10/2001 no. 430, the rules of the contest will be available to all participants on the website www.vistifiemme.it

The Promoting Subject reserves the right to amend all or part of the content of the articles of these regulations, taking care that the amendments made do not in any way prejudice the rights of the participants in the prize competition in accordance with the provisions of art. 10, c. 4, Presidential Decree 430/01. In this case, the latter will be made aware of the changes in the same way as they were made aware of the initial conditions.

ADVERTISEMENT

The contest will be advertised in the Internet (banners, pop-ups, stand-alone e-mails, social networks, advertising insertions) linkable to the website www.visitfiemme.it, and via e-communication.

In any case, the Promoting Subject reserves the right to use any other means of communication which appears suitable to bring the content of this prize competition to the attention of its recipients. 

GENERAL TERMS AND CONDITIONS
Participation in the Contest is free of charge, except for telephone and internet connection costs, which are the Participant's responsibility according to the tariffs applied from time to time by their operator. 

Participation in the Contest implies acceptance by the participant of these regulations, which are entirely subject to the law of the Italian Republic. The present prize contest is subject to the Italian legislation in force; therefore, each participant accepts the regulations and the legislation governing it. The competition shall be understood to be governed exclusively by Italian law.

It is hereby certified that this prize competition is in no way sponsored, supported or administered by Instagram or the Meta company or associated with Instagram or the Meta company. 

By participating, Users declare that they are over 18 years old.

PROCESSING OF PERSONAL DATA

It should be noted that all data collected by the Promoting Subject derived by the participation to the contest “Fiemme Smile” will be processed in full compliance with the General Data Protection Regulation GDPR 2016/679, and modifications, and for the purposes connected to the participation to the contest. To this end, the data collected may be communicated to Real Web Srl. - via Brennero, 120 - 38121 Trento, a company expressly delegated by the Promoting Subject and therefore appointed as data processor pursuant to the GDPR 2016/679 Regulation, to represent it in all fulfilments relating to the competition, including the drawing of the winners and the reporting operations connected to the awarding of prizes and the closure of the competition.

ONLUS
The prizes that won't be demanded nor assigned will be devolved to the no-profit organization “Cooperativa Sociale Le Rais”, (Via Fiamme Gialle 44, 38037 Predazzo, Trento, Italy, Fiscal Code 02487670222) in compliance with the art. 10 comma 5 of the Italian Presidential Decree 26/10/2001, no.430.
